We have to ALL bombard them. They are already investigating and I’m already in discussion with them, but it’s extremely important we all file individual complaints so they see the true volume of this. There’s already been 100 complaints at least, but we need more. 

Suing them will only do so much as the civil line is already so long. This needs to be criminal. And we need to push and do everything we can.

Over the past few weeks, I’ve done a lot of research into the ATM business, something we should have all done before investing. Here's what I found, and why I believe we were all misled.

The ATM industry is profitable, but not in the way Paramount sold it to us. In the U.S., there are around 500,000 ATMs, with 70% being independent, typically installed in retail stores for profit. These machines operate very differently from bank ATMs, which primarily serve their own customers.

While researching, I reached out to various companies in the industry, including large players like NCR, Brinks, and Euronet, as well as private companies such as Cash Depot, Cord Financial and ATM Link. The private companies were candid about Paramount's practices, with one even stating that they turned down an acquisition offer from Heller, feeling his business model didn’t make sense.

Here’s where things started to fall apart: The typical cost of a new ATM is around $3,000, and buying an already-installed machine might push that to $10,000. We paid upwards of $20,000. I also learned that most ATMs in retail locations process about 200 withdrawals per month. Paramount, however, sold us on projections claiming up to 3,000 withdrawals per month. This was unrealistic. Only bank ATMs process over 1,000 withdrawals monthly, and those don’t even generate fees for the bank unless they’re used by non-customers.

The truth is, most retail ATMs only generate a few hundred dollars in net income each month. Big companies thrive by processing many transactions across a large scale, partnering with banks, or running ads on their machines. Paramount, on the other hand, relied solely on cash withdrawals—and poorly at that.

I also found out that Paramount had a terrible reputation in the industry. Operators said they often left ATMs out of service for days and failed to pay merchants on time. Many vendors stopped working with them because of their late payments.

To sum it up, the business model we were sold was a lie. Paramount relied on new investors to buy in so they could pay off previous ones and continue charging high fees. When interest rates went up and acquisitions slowed, their business crashed. I should have done my research before investing, but it's too late now. The company is gone, and our money is with it.

Finally, according to several ATM companies, 80% of Paramount’s locations have been taken by competitors or sold off. What's left is the worst of the bunch.

In conclusion, we’ve been taken for a ride. Our only hope now is that the authorities investigate and hold those responsible accountable. Unfortunately, there’s zero chance we’ll get our money back. Trust no one with your money, and remember: if it sounds too good to be true, it probably is. Let's hope the raids this morning are but the start of us getting some type of justice.

In a recent post below, I fully identified myself, and given the large response it received thru direct emails, I’d like to reiterate my message here for the broader community in case you haven't followed the thread in its entirety.

My name is Jorge Fernandez. I worked at Paramount Management Group and Powercoin from 2017 to 2023, holding various roles, some with formal titles and others in more informal capacities as the person who "just got things done." My primary title was Chief Development and Marketing Officer. I worked exclusively at Paramount until 2019, after which I created a division within the company to participate in the rapidly growing crypto ATM industry. Eventually, I started Powercoin within the Heller Capital family as the sector expanded. For a time, I served both companies until I transitioned my duties at Paramount to another team member.

I am sharing this information to encourage others to step forward from behind the pseudonyms often used on this platform. We need a more open and candid conversation about the unfolding situation, without fear. 

Since posting my original message below, I’ve received numerous emails from individuals seeking information, with many asking whether those of us who worked at Paramount knowingly participated in, or were aware of, the financial issues now coming to light. Let me be clear: during my time at Paramount, it was an active, legitimate business. The company operated thousands of real ATMs, generated revenue, employed dedicated individuals, and we all genuinely believed we were building something special.

However, the inner workings of Paramount and Heller Capital were known to only a select few. Despite my title, I was not part of that inner circle, nor were many others who gave their time and energy to the company. Many of us are now watching in horror as the company unravels, and some of us are reading or even participating in these discussions. To those individuals, I say: don’t be afraid to step forward. There is no shame in having worked there—we are just as much victims as the investors, vendors, and merchants who hosted our ATMs.

To others in the community, I ask that you avoid casting blanket judgment on anyone with Paramount, Margo, or Powercoin listed on their resume or profile. We are just as frustrated, hurt, and disappointed as you are. We’ve suffered great losses, whether it’s money owed to us or the potential long-term impact this experience may have on our careers. Let’s all focus on fully understanding what happened. Many of us know pieces of the story, but it’s important to recognize that the Heller firm operated with a high degree of secrecy. We, too, are left with questions and can only speculate about the full extent of what transpired.

Until others are ready to come forward, I will do my best to answer your questions to the best of my ability.

I keep saying go look at the people that left and why, so far I’ve discussed Austin Haller and Barry Rynearson.  Today I offer Mr Dan Berkhokder.  Dan was President of Heller capital and chief cultural Officer.  Insiders tell me he was the one to create their “values”, you know the ones they published so they could violate? Anyway, Dan worked at North Group in Lititz prior to Heller capital.  He was Daryl’s right hand man and spiritual leader.  Dan was Robin to Daryl’s Batman.  Dan attended every meeting and was deep deep inside the organization. Then, a few months ago, puff, he suddenly just quits.  Again, why?  I think we know why, he saw what was coming and followed Barry out the door.  

Curiously, if you look at Dan’s profile today, there isn’t a single mention of Heller Capital and he has erased his social media footprint, only appears in North Group’s website with a brief “about him”.

So, big big, biiiig smoking gun here.

I’m just wondering..At this point it’s obvious to even the dumbest of us that Daryl took your $, spent your $ living largely, bought cars and homes for his many girlfriends, even his kids and their friends went to super bowls, olympics, greece, italy etc all on Daryl (you). Putting this out here for everyone to digest:

1.  I have spoke to outside counsel who have been following this case since it was published in the newspaper.  I can say without a doubt that both federal and state law enforcement agencies are 100% doing an investigation.   And while the outside counsel doesn’t have specific detail they did allude to their internal relationships that major news worthy events will happen very soon.  

2.   Th is is not the only group who speaks about this on a regular basis.   There is a large group of major investors who have been communicating daily and have pushed legal entities to pursue judgement.   They gave the execs time to get their shit together but those internal deadlines have passed.   Reason they waited was to prevent funds going into receivership.   

These guys won’t get away with anything.   Indictments take time since evidence must be presented to a grand jury.   Once they decide then warrants have to be issued by the judge.   Then and only then will arrests be made and it won’t be pretty.   These guys are looking at mail fraud, wire fraud, RICO, money laundering, etc.  Minimum of 10-15 years and it won’t be at a country club prison.

One of the biggest frauds portrayed by the fund managers was that in the event of Paramount not holding up their end of the bargain, they could take over the ATMs, operate them, and pay out distributions.  What a fraud!  There will be no ATMs worth a dam. There are no margins. The money is gone. Time to move along.

Hi all - wanted to share some information I learned today while being interviewed by a DOJ agent. I asked how this process unfolded for them, and without answering many questions, the agent flat out told me they received countless complaints of fraud. 

So just wanted to share: you all made a difference. You spoke up, reported the appropriate parties, banged the drums, made noise, and it worked. The walls are closing, and I’m becoming very confident that this fraud will be exposed and arrests will be made in the next 30 days.

Let’s keep it up. If you haven’t reported them to the FBI and SEC, keep doing it. I highly encourage you to also report your syndicator (Zook, Hostetter, etc) to the FBI and SEC personally as well. Anyone who knowingly or unknowingly sold a fraudulent product by a fraudulent company needs to be held accountable. As a note: though it seems this current existing legal process is “for you”, it’s not. It’s for Zook to make him look like he’s the white knight. He’s paying for it, and it won’t help you at all. 

As I said in September, they’re all going down. We may never get our money back, but at least we will get to witness some justice

New article up on Lancaster Online.  States an employee gave testimony and said many of the ATMs Heller claims existed either don’t or are owned by others.  Said at most Paramount has/had only 10K not 25K.   
 
Also another ATM operator reviewed the list and said some of the ones Paramount claimed were actually his.   

This is so damning.   Heller and Co are done.   Minimum of 10-15 years for bank fraud, wire fraud, mail fraud, money laundering, Ponzi, etc.

Here is another golden nugget to look into. Erin Farabaugh was Heller Capital’s chief legal officer for about 3 years. She bailed in October. Again,why? It’s yet another testament how all the executives started leaving when things were about to explode.  

Like rats running out of a sinking ship, we must wonder how all of these people, I mentioned most of them in previous posts, hung around for so long, obviously benefiting from the scam until they realized it was over.  IMO, these people have to be heavily investigated as much as Zook, Jerry and company. 

Erin was as close as one can be to Daryl, she has to know a great deal about what went on. Let’s talk to her. But in an interesting twist, she sanitized her LinkedIn profile to erase any mention of Heller, why, are you ashamed now?

This statement by the judge says it all. “What started off as an investment returning income to the Funds appears to have transformed into at best a significant under-capitalized expansion of ATM buying
or at worst a Ponzi scheme”.  I believe it is the at worst scenario.

And the fun never ends.  Voting has started for the potential buyout of investors and 2 days later Zook sent out an email letting investors know that the FBI and SEC have open investigations into this whole mess.

Wow. Just processing that testimony. Our money is gone folks. I guess I had a slimmer of hope, but it’s painfully obvious this entire thing was fraud. Serial numbers, locations, ownership… well over 50% of it wasn’t even real. 

Overall, I can’t even begin to describe how screwed they are. Daryl won’t do less than 20 years in prison for this when it’s all said and done.

From where I stand, there are a few fascinating things unfolding right now that are definitely worth paying attention to. First, Daryl’s bold move of showing up to his criminal contempt hearing without a criminal attorney by his side—now that takes guts. It’s almost impressive, really. You can practically see the transformation into the hardened criminal he’s become. Cool as a cucumber while all the thousands of people he’s wronged, stolen from, and hurt are left out in the cold. It’s honestly a bit unsettling to witness the smugness he exudes, but hey, it’ll make the eventual day of reckoning all the more delicious when he breaks down into tears like a little girl.

Secondly, let’s talk about the employee who finally decided to turn on him. A true hero in the making, right? I mean, it’s a huge relief to know she opened the floodgates on information we had all suspected but didn’t have concrete proof of. This is just the beginning. I’m sure others are going to start lining up to sing like Pavoratti on opening night at the opera, and as the feds dig deeper, Daryl’s inner circle will implode. My money’s on Randall being the first to crack. With his meek little demeanor, he’s a perfect candidate to fold under pressure the second he’s behind bars. I don’t think the poor guy could survive a single day in jail.

Let’s play a little game of “Who’s Gonna Crack First.” I’ve got Randall as my #1 pick, followed by Dennis. Seriously, this guy’s house looks like an episode of The Brady Bunch—six kids, a mountain of responsibility, and zero chance he’s willing to go to jail. He’ll fold the second the pressure’s on. Then we have Erin, the corporate attorney, who isn’t about to risk her precious law degree over a shady criminal like Daryl. Barry’s up next—he’s in the twilight of his career, and the idea of ending his days behind bars for Daryl Heller? Yeah, not happening. I’m calling Barry next to crack.

Dan will likely hang back and see who jumps first, but let’s be real—nobody’s taking a jail sentence for Heller. And then we have Austin and Rick, both of whom have already been burned by Daryl. Austin, in particular, is a classic case of “save yourself first.” That “all-American boy” look? Yeah, in prison, he’s going to be prime target material. He’s going to sing the second the feds knock on his door.

As for Zook and Jerry, well, they’re doing their own thing. They weren’t even at the hearings, probably cooking up some plan to quietly exit before this whole thing blows up. They’re clearly trying to save themselves, but the bottom line is, every single one of these people is going to turn on Daryl. Because guess what? When it comes down to it, humans have zero loyalty when their own skin is on the line. Sure, they might have made some money off him, but they’ll be the first to turn on him once they realize he’s screwed them all over in the final act of this tragedy.

So those are my bets. I’m fresh out of money to place on the table, but let’s do this “for fun.” What’s your ranking? Who do you think cracks first, second, and so on?

The amount of people associated with this claiming “negligence” or “they had no idea” is the part that will be interesting to see when arrests and charges start being made.  If investors were consistently asking questions about the validity of these ATMs and being reassured everything was 100% legitimate and profitable, that to me is punishable by the law.  People in Paramount, Prestige, Real Asset Investor (Zook), and Margo never batted an eye or questioned the validity (when investors were) when selling funds and collecting money. “Everything could be accounted for.”  That’s lying and the audits they kept asking for (and never received) should have been thoroughly evaluated before ever selling another round of funding. I personally have a hard time believing that Daryl Heller was able to fabricate all of the necessary documents to such exact precision that questions shouldn’t have been raised internally.  Thats why the testimony of others knowing that fake VINs were being used was so powerful.  Other people knew. Time will tell, but negligence shouldn’t mean innocence.

I’m just soo confused with all of these millions in defaulted loans, money from investor’s  for ATM’s that weren’t even bought,  ATM’s that were sold off, disbursements from ATM’s that weren’t paid- where is all of the money?! We are talking about 100’s of millions- easily.  Payments all stopped around April. How do you get rid of that much money without hiding it?

Sounds like it at the very least turned into a Ponzi scheme the last several years? If that is proven, will the syndicators also have some responsibility to try and make the investors whole?

Check out this aother SEC &amp; federal bankruptcy case in Texas with Dave Zook and the guy he says has mentored him since he was an Amish  teenager, William K Poole. Its caption is: SEC v. Roy Hill, Eric Shelly, Clean Air technology; and it’s in US District Court, western dist. Of Texas, Waco Div., case no. 6:23-cv-00321. 

It’s an oil and gas investment where Zook brought in lots of Lancaster people (look at the receiver’s report for quarter-3 of ‘23. It lists all the investors. Lots of Amish and Mennonite investors). $360 million raised and $60 million of that was from Zook and Lancaster. Bankrupt. 5/6ths of the money just vanished. 

I wonder how many more of these frauds Zook and his online investor friends do and supposed  mentors have all over the country. Somebody said they are selling investors on car washes all over the place, but far from Lancaster so no one will really know if they are real. Has anyone else heard that? My uncle who spent his life driving truck and working farms for other owners put everything he saved into the atm reinvestment. Looks like nothing is coming back. Luckily he never tried to get the IRS depreciation so that’s one thing he don’t have to worry about.

A partially redacted transcript has been posted on the legal case in the link on the main post (see 9/16 entry). It covers the emergency injunction hearing which occurred Aug 26th and went for several hours. The attachment is 73 PDF pages and much of it is testimony from Daryl Heller. The redacted portions are confidential business information about Paramount. One of the question which wasn’t redacted was from Haverstick to Heller asking if Paramount has more or less than 15 million dollars in the bank. The answer was redacted, but I think we can make the logical assumption that the answer was less than 15 million. There are some funny parts where the two lawyers insult each other. The biggest takeaway I got from it is that no one knows precisely how many ATMs are in service. Heller answered with a ballpark estimate of 25k-30k. The fact that he doesn’t know more precisely off the top of his head and the fact that the ATM owners (the 25 investment funds) don’t know is mind boggling.

Tomorrow will come and go with more broken promises and more delays. The money is gone. 

Zook and Hostetter were blinded by greed, imo. They knew Daryl was doing fishy shyt. They chose to look the other way and continue taking overrides and fees. Daryl had never missed a payment, was the go to line.  The rise in interest rates put the fraud in the sunlight. If covid low rates would have stayed longer, Daryl continues the fraud longer. Once his borrowing costs behind the scenes exploded, he was done. 

Here is a second installment of another rock to look under for information about where your money went.   Look for Barry Rynearson, he was Heller Capital’s CFO.   He got up and suddenly resigned in Feb 2024, right before the excrement started hitting the proverbial fan.  One of the first signs of a company being in trouble is when the CFO suddenly leaves, they know what is goin on and after the financial reform regulations after 2010, they are one of the first one’s to go to jail so they are really careful of bailing from risky situations. 

He was one of Daryl’s inner circle members and he just left one day.  Ofcourse the excuse was “retirement”, but he is not an old dude and has not retired, so, we can assume he saw something coming and bailed.  

So, look for Barry, he is right here locally and ask questions.

There is a new lawsuit filed today between Jerry Hostetter and Heller Capital Group (link below). Perhaps this is intended to replace the Prestige/Paramount one dismissed today. There are no documents uploaded so far, but it looks like Jerry is trying to get a custodian appointed to control Prestige. Since Daryl controls Paramount and Prestige, maybe Jerry needs to remove Daryl before he can proceed with further lawsuits.

I never bought into this investment and thus don’t lose anything. If anyone bothered to ask a series of basic questions, one quickly found out that this was too gimmicky for it to be real in the long turn.  When I asked for references they only allowed me to talk to a select few number of investors, not the ones I chose.  There were never audited financials, the “too good to be true” alarm kept going off in my head, there was never much clear information coming out of the fund, I kept reading things of concern on the press about the business which they kept avoiding and providing “canned answers “ to my concerns.   

Then Bernie Madoff happened and it all sounded too similar to me.  It was my perception but I’ve learned to trust my instincts and I was 100% on target on this one.  People need to learnt to research who they give money to, these type of individuals pray on the greed factor and they know that they can promise something that is too good to be true and people will fall for it.  I feel bad for those that lost money, but if the thousands of other examples from the last 20 yrs hasn’t been enough, let this one be a lesson. Don’t give a dime to anyone that is not transparent from the start.

Just got the latest “delay again” email from Prestige.  These guys should all burn in hell for ripping off people for 100s of millions of dollars.   At least my fraud complaints to the regulators are being answered and investigations are being pursued.

These are all SCAMS.  Dave Zook and Team are scammers.  They target Small Business Loans, Doctors, Dentists, and Small Business Owners who are high net worth individuals.

To all the investors. The proverbial “fat lady” has started to belt out her notes. If you haven’t realized by now you are not getting any money, now would be a good time to come to terms with reality. Paramount is now in implosion mode from which there is no return. 

You’ve been duped.  Find out for yourself, call the company tomorrow and ask how many merchants they have left. It’s dwindling by the hour. Doubtful they will make payroll this week. 

What’s left now is that you step up your efforts to bring those responsible for stealing your money to justice. This was preventable and either thru ill intent or gross mismanagement, your money is gone

You folks seem to need some help getting motivated in looking for your money. Since I seem to ask more questions than the majority of you, who have actually lost money, let me attempt to point you in certain directions at least. 

Here is the first clue.  You need to be looking at people that have left the company and why. Let’s take a look at Austin Haller for example.  AH was the CEO of Margo network, their bitcoin business. Austin reported to Daryl directly and he is the son of Rick Haller, Daryl’s one time best friend. Him and Daryl jointly owned Cash Ventures, who in turn took out a bunch of loans.  Daryl defaulted on 
Most of  these loans and it seems the relationship soured.  It seems Rick allegedly told his son to resign since he suspected of certain things going on at Margo.  It’s been reported that Austin’s resignation was not well received by Daryl and that Austin made some upsetting comments that POd Daryl. 

What’s important here is  not what was said or who got upset.  What’s important is to understand what spooked Rick and Austin. They were deep on the inside and they ran for the door. I would say there is a potential smoking gun there.  So, you Mr/Ms investigator, investor or debtor, there is a clue to follow. 

Don’t be lazy, most of this information can be obtained thru public filings, newspaper reports and by simply talking to people. No one likes these folks, all you need to do is ask a simple question and the information flow inundates you. And the lawsuits are a treasure trove of information, all of that is online. Also, Rick and Austin live right in our community, catch them at the coffee shop and ask.

I've been reflecting on what transpired yesterday at Paramount's office and Daryl Heller's house and pondering what it truly means for all of us who invested in this nightmare of a scheme. On the surface, it seemed like a moment of vindication—as though our pleas were finally heard, and the "cavalry" had arrived to rescue us.

However, as the effects of the second glass of wine wore off and the initial euphoria faded, rational thought took over. I began to question what tangible results, if any, we can expect from this.

I’ll admit, there is a certain satisfaction in seeing Mr. Heller face the humiliation of having his office and home raided by federal authorities in full view of his community—the very community he exploited. That alone feels like a small victory, a moment when our cries for justice were acknowledged. But that satisfaction is fleeting. History has shown that individuals capable of orchestrating financial crimes of this magnitude lack the moral compass to feel genuine shame.

Heller's colossal ego will likely twist this situation to place blame on anyone and anything but himself. Then there’s his inner circle—Zook, Hostetter, Pool, "Buck," Roll, and the rest. Thus far, they’ve managed to evade the public eye and, seemingly, the scrutiny of the law. We can only hope they’re not sleeping too soundly.

But pragmatically, where do we go from here? It’s clear that legal troubles for this group are just beginning, and rightfully so. Yet beyond the fleeting sense of justice, what do we, as victims, gain? The answer, unfortunately, is “not much.” Most of our money is likely gone, with little hope of recovery.

The most heartbreaking aspect is that many of the investors in this scheme were not in a position to lose that money. I personally know of countless difficult conversations with family members and friends that began with, “Remember that money I asked you for? The incredible investment opportunity?”—only to end with crushing disappointment and regret.

Now, this group will spend millions defending themselves, ironically using funds they took from us. Untangling the intricate web of shell companies they used to perpetrate these crimes will take years and significant resources. That’s a task for the authorities. For us, it feels like we’re merely spectators in an incredibly expensive movie—one that we unwittingly financed.

There is a new court case / loan default against Heller Capital Group for $9 million. The other party is Deerfield Capital Group (“Private direct lender for small balance commercial loans”) which is run by its president, Eric Warfel. That is a name I haven’t heard before and this may have nothing to do with Paramount. The collateral for the loan is “Heller Investment Holdings”, “GCC Investment Holdings”. I don’t know what these represent, but maybe Heller stands to lose his investments in the non-ATM businesses under Heller Capital Group. The loan was created in April 2024.

The worst thing a person can do at this point is expect another dollar from this fraud. Write it off mentally and never look back. I’ve lost on investments before and it will gut you to the core to dwell on it. Learn from the mistake, never do it again, but move on. There are no atms, there are no keys, there is no value. He gutted you once, only you can control how he affects you in the future.

So now he is playing the victim card?   Those dollars you invested Dave were from the points you got from screwing investors into the ATM fund.   So it’s not really your money that you lost.   Scum bag.  Can’t wait for the SEC to disgorge the last decade of your involvement.

Am I the only one who thinks that this whole investors lawsuit was a delaying tactic to stop the clawback from the inevitable lawsuit? There's growing concern about a company called ATM Ops Inc and its potential involvement in diverting assets originally purchased with funds from investors and lenders of Powercoin (Margo). Reports suggest that Bitcoin ATMs and host locations tied to Powercoin are now being rebranded and operated under ATM Ops Inc, leaving investors and creditors at risk of losing their rightful claims to these assets.  Even more interesting, it is rumored that Daryl owns a stake in ATM Ops Inc.  

For example, a kiosk owned by Powercoin and [previously operated as part of Margo](https://coinatmradar.com/bitcoin_atm/74620/bitcoin-atm-genesis-coin-frederick-royal-farms/) has been rebranded as a  Bitstop as you can see in photos on this [location listing](https://coinatmradar.com/bitcoin_atm/89573/bitcoin-atm-bitstop-frederick-royal-farms/). This does not appear to be an isolated case—other machines, such as those at Royal Farms locations, follow the same pattern of rebranding and operating former Margo machines as Bitstops.

This raises critical questions:

* What is the relationship between Heller and ATM Ops Inc?
* Is this arrangement authorized by Powercoin's investors?
* Are creditors receiving any benefit from the continued operation of these machines?
* Or is this yet another shuffle in a high-stakes game of three card monty, where assets are continually moved to evade rightful claims?
* What steps can be taken to investigate these concerns and safeguard these assets?

Hey everyone, I’m a buddy of Ethan’s and want to correct a few things that I see on here regarding his home. 

After Ethan graduated college he decided he wanted to live in Lancaster within walking distance of his job. 

As a recent college graduate, Ethan did not have a credit history. Ethan picked out the house and his dad helped him with the down payment (as any father would do if they were able). 

The only reason Ethan’s father was on the deed or mortgage was as a co-signer (the bank required this). 

Ethan found a real estate agent, Ethan found the house, Ethan negotiated himself, Ethan has always paid ALL the bills and the mortgage without ANY help from his dad.  The plan was always for his father to be removed from the deed as soon as possible.  

The way this has been reported is grossly INACCURATE and unfair to Ethan and he does not deserve the vitriol that is being pointed his way. 

My plea is that everyone show a little compassion. Ethan has always been one of the steadiest, kindest , generous and good hearted people I have known. It breaks my heart to see what some of you write and I’m asking for you to show a little humanity for a situation that is very hard for us all to experience.

As you may or may not know, Paramount and Prestige sent correspondence this morning notifying us that they will be breaching the settlement agreement by not making the first payment on time.  They said the managers have agreed to give Paramount an extension until the 31st of October.  I do not see anywhere in the settlement proposal, or in the ballots that we cast, a provision that grants the managers authority to deviate from the mandate they were given.  Provided Heller's history on this case, no extension should be granted and the suit should be reinstated.  Failure to perform by the date of the agreement is a material breach and no other remedy has been contemplated or authorized.  

  
The fundraisers like Dave Zook at the Real Asset Investor have a duty to defend their investors.  Failure to enforce the contract is just further evidence that they are going to continue to let Heller play games and not hold him accountable. Every promise Heller has made he has broken.  There is no reason to believe he will comply with this extension.

If you make an investment into a smaller size organization and within months the senior managers start driving expensive cars, buying bigger houses in private communities and start living a lifestyle beyond what is reasonable for what should be their income, shouldn’t bells be going on in your head?  If you live near them, didn’t anyone see the sudden lifestyle change of Paramount managers?  Suddenly they started driving very expensive cars, hanging out nightly around all the high end restaurants in town and drinking very expensive drinks. This is a small community and things like that Stand out.  It did for me. We haven’t heard too much about Randall Leaman, who was head of Paramount.  Do you think he might be singing about now, or do you think he will continue to deflect and try to fight to the end like Daryl Heller seems to be doing? It would appear the hole is getting deeper.  I wonder if Randall will realize that and come clean or go down forever tied to Daryl.

A few thoughts from the Signal\_Sender 

1. Everyone that worked at PMG knew the ATMs were not PMG property. Machines could never be sold for this reason. If an ATM was damaged beyond repair, any recoverable parts of the machine were brought back to the warehouse.

2. From a distance, some of portfolio acquisitions did not seem financially viable.

3. I even recall one communication proposing the purchase of obsolete ATM assets, though I am unsure if that purchase was ever completed.

If the FBI has not already done so, they should bring in all longtime PMG C-suite executives and VPs who worked in M&amp;A and finance, including their children who were employed at Heller.

They should be gathered in one room and reminded that making false statements to law enforcement and obstructing justice are serious crimes. Then, they should be privately interrogated—and then we will know who was involved.

This could not have been orchestrated by just two people at PMG.

I appreciate all the input and support we’ve been sharing here on Reddit. As an investor myself, I understand the frustration we’re all feeling—these updates are vague, lacking substance, and seem designed to pacify us rather than inform us.
They keep extending the timeliness despite the evidence of more than a dozen broken promises.

While these conversations on Reddit are valuable, they won’t lead to meaningful action unless we organize and approach this objectively. I’m not very familiar with managing these kinds of discussions on Reddit or any social media forum but is anyone here able to help coordinate? It would be useful to start by identifying how many investors are part of this group and finding a way to present our questions and concerns collectively.

If we want real answers, we may need to demand them ourselves—otherwise, we risk being sidelined indefinitely.

I have been reading posts on reddit for the past few months and I find all of this to be surreal. There are apparently no working ATM's on the PA turnpike and there is almost no press coverage and no outrage. The problem was "unforeseen" or there is a "glitch". There has been almost no meaningful coverage in LNP. This problem has been going on since April, 8 months. In this community I would think a scam that could be as large as 700 million would get the newspaper's full attention., There are hundreds, probably more, investors in the Lancaster area that are and will continue to suffer serious economic harm and yet the perpetrators , from what has been posted on Reddit, are living normal lives. All of this in a very small community. What am I missing as an outside observer?

I’ve been in the ATM business as an ISO similar to Paramount Management for about 25 years. It was clear that Paramount’s business strategy was unsustainable. it focused on heavy marketing rather than growth and over spending. I feel for the investors but in this industry once you fall there’s no going back. Retailers won’t tolerate ATMs sitting empty for more than a week before switching to other companies, especially when contracts are breached due to poor service. At this point investors can only hold those responsible accountable and claim their losses on taxes. Unfortunately, from my experience the chances of recovering their investment are close to zero

* The current litigation is a fight between Prestige and Paramount with Heller trying to derail the litigation by claiming that he is the majority owner of Prestige and stating that he should be able to kill the suit because the manager did not have authority to bring suit against Paramount. The problem is the self-dealing since Heller owns Paramount.  Heller is essentially withholding funds he contractually owes to Prestige, but since he owns most of Prestige, he is claiming he is the one who gets to decide whether he can be held accountable thereby allowing him to steal money from the minority investors. 
* Here is what is not part of the suit right now: the minority investors in Prestige bought in through fundraisers like Dave Zook at the Real Asset Investor.  I understand that Zook was very close with Heller and knew that Heller was not producing material information regarding the health of the ATM business or its failure to provide crucial information about the ATMs and the accounts where the proceeds were being deposited.  While this was occurring, Zook was still raising money for the Prestige and not disclosing these problems to potential investors regarding the self-dealing conflicts that existed with Heller.  
* It is unknown what is left of any resources that may be available to the investors if the Prestige lawsuit is ultimately successful. What needs to happen next is to interplead Zook and the Real Asset Investor as parties to this suit so that there are additional resources available to make investors whole.  The longer it takes to bring Zook into this litigation, the more time he will have to move his money around and hide it from investors.

There is no proof Daryl has a nickel to his name. Signing documents does not equal funding. Prepare to be disappointed by Daryl yet again on Monday. 

I’ve been communicating with Zook and he does not sound optimistic about the funds coming through.  His attorney has been negotiating with Heller’s attorney and they ”conveniently” signed nondisclosure agreement so the material details of how the funding is supposed to work or any contemplated additional security that Heller was going to pledge will not be disclosed to the investors.  To be clear, Zook has been leading investors to believe that his attorney represents their interests.   This is not true.  There may be some overlapping interests between Zook and his investors, but there are some glaring conflicts.  If litigation resumes (which is probably the most likely scenario given the history of this case) then it would behove the investors to get their own representation so we can all be privy to the negotiations that are going on and bring a separate cause of action against Zook for his breach of duty to his investors. 

Heller may have a pretty deep line of creditors looking to get whatever they can from him, so we should be positioning ourselves to get what we can from Zook.

If you’re a long term investor you may not want a lawsuit. Sme of the money that you received may have been taken/stolen from later investors and can be recovered

IF there is no payment on the 20th, I GUARANTEE YOU, no one will be taking over the 25,000 ATMs. I can assure you that Dave and Jerry absolutely know this and all the investors need to understand that they will not be getting ATMs if the payment isn't made. You learned a valuable lesson about being optimistically greedy and blissfully ignorant. And why Dave and Jerry never demanded the necessary information (financial info) to understand this investment or the monthly performance, especially as syndicators, is beyond me and negligent. Whether it's criminal remains to be seen.  Will there be any money offered to buy back the ATMs? I have no idea. But you all are getting what you deserve for failing to be courageous and walk away if you or you syndicators walked blindly into this. Does anyone know how much each syndicator made per $52,000 atm buy in? I’m curious if we would be able to sue them for atleast their commission off of each sale. I invested late in 23 early 24 and have made less than 5% on this “investment”.  I feel this late in the game that LANE KAWAOKA could not have done proper due diligence unless all financials were fraudulent. 

@originalphillyjoeD- please look into the illegal dumping/selling of Paramount assets, which belongs to the investors, by Daryl Heller. One such example is the sale of the Cypress portfolio, around 9,000 ATMs which was sold to one of Paramount’s competitors, Cash Depot in September. This portfolio originally cost nearly $20,000,000 yet it was sold for less than $2,000,000.  

Secondly, Foneco, a company based in Chicago, originally purchased for $18,000,000 was sold back to the original owners for $5,000,000.  This is a clear illegal disposition of assets that did not belonged to Heller capital or Paramount. This company had approximately 2500 ATM’s.  

So, almost $40,000,000 and approximately 12,’000 ATM’s were stolen and sold illegally and the money was pocketed by Daryl. 

The man is a thief, a cheat, a liar and a criminal in every way.

I understand this is Lancaster County and everyone knows everyone, but with this new lawsuit being assigned to Judge Conrad, there’s a lot of content out there with Judge Conrad being friends with the Heller family, specifically Daryl’s brother, Dan. How is that not a conflict of interest?

More filings (1/31) from the Funds against DH and Paramount.  Looks like Daryl isn’t complying with the judgement.   I guess why would he comply with any of the civil suits when the Feds are about to perp walk him with an indictment that incarcerates him for the remainder of his life.

Wow, interesting article about the Deerfield action against Heller.
