They have not said that what Noem is doing is "legal", that was not before the court. The only question was about halting the deportations while the court case is on-going in the 9th Circuit.

Still not a good thing or good ruling, but I wanted that clarification there since the news can't seem to actually read the order. They have stayed a lower court's ruling pending the Disposition of the 9th Circuit on the appeal AND the Disposition of a "Writ of Certiorary" if one is "Sought timely".

The order also notes that "Should certiorari be denied, this stay shall terminate automatically." - In other words, if certiorary is denied, then the stay will terminate and the lower court's ruling preventing the deportations will be back in effect.

IF I'm understanding all this correctly.

This is just an example of Trump reversing an executive order of the previous administration. 

Now, however, the rubber hits the road on what to do with 607,000 Venezuelans who just had TPS (temporary protected status) revoked. Venezuela has agreed to accept flights carrying Venezuelan deportees. At about 200 per flight, this would be a bit over 3000 flights from the US to Venezuela, in a climate where there has been zero -- repeat zero -- civilian flights between the US and Venezuela for some time. If the intent is to repatriate these in a year, there'd have to be over 10 flights a day every single day. The alternative of sending Venezuelans to El Salvador or Cuba or Libya is not a deportation by repatriation, and in fact will be dealt with separately as a kidnapping/imprisonment in courts.

As much as this is disgraceful from a moral standpoint and a complete breaking of America's word to these people, it's a different legal question. 

Something that also needs to be recognized. Their status here lasts 18 months, subject to renewal should the government agree. Even best case scenario, the court tells the admin to wait the 18 months out. 

I would've denied the emergency application and let the litigation play out. That said, even doing that is not going to help them stay here in the end. It'll only have given them more time to get their affairs in order.
