It's really important in these discussions to understand that ICE has the authority to detain and arrest citizens as well as aliens.  There is a massive misconception as to the limits of ICE's statutory authority, but they are legally able to arrest and charge people for crimes that are not immigration-related.

I'm not sure. Probably not. It seems more problematic to me that they picked this guy up while enforcing a policy that a judge had ruled they could not enforce.

Others seem to be based on racial profiling, which is hard to prove, but probably doesn't violate due process because they were either let go or released after some reasonable time in detainment. Still others like Julio Noriega were detained despite holding *on their person* documents proving their citizenship. And then there's the case of Jose Hermosillo, a man with learning disabilities who was held for 10 days despite claiming citizenship, with a whole bunch of paperwork issues that suggest somebody at BP was trying to cover their ass and didn't care about what the detainee had to say. Even in these last two cases, which seems egregious, the detained individual was released once citizenship was established beyond any reasonable doubt. I think the final case is probably the strongest one to suggest a due process issue, but that's Border Patrol rather than ICE, and I think every policing agency in the country has issues dealing with people with learning disabilities and illiteracy (which doesn't excuse it, we should fix it).

I am not sure the idea of rounding up every brown person who doesn't speak English well is sustainable. Unfortunately (or fortunately?), I don't think that's a discussion of due process, but of agency culture and overzealous enforcement.

Your question is so politically loaded you’ll never get a real answer on the internet. Everyone seems to have a very strong opinion. 

What do you mean by “detained”? Is a couple hours for questioning equivalent in your eyes, to say, sending someone to an immigration detention center? Would you be upset if ICE agents arrested citizens on suspicion of crimes unrelated to immigration, but that they still can legally arrest for? Are you worried about deportations of citizens who are small children if they’re expelled with their illegal immigrant parents who want to keep the family together and chose that option?

Think about the answers to those questions. Yes there have been a handful of citizens detained or even arrested. Whether or not you think it’s a big deal depends on your answers to my above questions.

First - there is no such thing as a legal citizen.  You are either a citizen or you are not. Not every immigrant is eligible to apply for citizenship and at min they need to be in the US for 3-5 years before filing. There are legal immigrants. This includes people with legal status (like permanent legal residents, or people with any variety of valid visas) or legal presence (people who may have crossed illegally to seek asylum - which is in fact legal), people with temporary protected status or any number of the many legal immigration processes the US offers.  

That said, if you mean to ask if ICE agents are arresting Legal Immigrants- the answer is yes. There are multiple examples of people having their greencard or protected status revoked - for some accusation without any supporting evidence (Mahmoud Khalil), Mondawi was arrested when going to his citizenship interview (later he was released b/c the government could not produce any evidence/reason for his arrest, Ozturk was arrested by plain clothes officers for writing an oped - and recently there was a guy in Whitefish, MT who was arrested, taken out of state and set freee after a lawyer volunteered to represent him - with no ride home. All of these are examples of legal immigrants being arrested without breaking any law including immigration law. There are more examples too, this is just a few.

That is not happening.  Everybody is getting due process.  Those claiming otherwise are really just complaining that deportation has a different process than a criminal prosecution.  When you are prosecuted for a crime, you go before an Article III judge have have a bunch of due process rights, such as a right to a jury trial.  

Deportation, on the other hand, is 100% internal to the executive branch.  And that has always been the case.   Immigration judges are not Article III judges.  They are DOJ employees appointed by the AG.  They used to be called "special inquiry officers."  If you are detained, you can bring your dispute to an Article III judge by filing a Habeas petition.

ICE is the most lawless organization in this country, and has been since its inception; common criminals are subject to laws, but ICE is allowed to act with impunity, cruelty and arbitrariness without any accountability. The fact that there has been no "shootouts" involving ICE or any of the people they have been  detaining actually calls into question if those they are detaining are actual "criminals" or working people selected because they are easy prey for them.

I have family (My father, his mother, and 13 brothers and sisters) that literally came here illegally from Mexico. If it was really as much an issue as they're saying, I'm pretty sure I'd have heard something. 🤷 Oh they came here from Zacatecas BTW which is basically the center of a massive war between Cartels. "Legal" also means that one can be a legal immigrant to this country, and if they overstay their visa, don't meet the requirements, get into legal troubles, etc.. they will then be deported back from wherever they came and rightfully so. 
If you choose to come to America, you must obey her laws. When I chose to move abroad, I had to learn their language/customs/culture and adapt to it. They are no better than anyone else to do the same.

No one is answering the question .  The answer is no.  While there has been a lot of propaganda claiming citizens and legal non criminal residents have been detained and deported ,  when all the evidence came to light , it’s all been proven untrue.   There is leftist hysteria over criminal non citizens being held accountable and it’s not based on the reality of how illegal immigration affects communities.  I’m in the construction industry in California and I’m Latino.   It’s a huge financial and criminal burden. So... the attorneys failed to tell their clients they'd lost their appeal.  Awesome. Unfortunately A) yes they're removable, absent a stay being in place, but positively, b) they've likely got a nice ineffective assistance of counsel claim they can/ should file, assuming the appeal wasn't denied the same day or something like that.  Also, c) being removed does not prevent pursuing a petition for review in Circuit Court (assuming the above means they've lost before the BIA; they could / should, though, file a motion to reopen with the BIA either way in order to exhaust their available remedies on the IAC question).

Does anyone really believe that ANY applications for asylum will be granted? I doubt they'll approve a single one. At this point, if I had an application for asylum in the system, I'd just assume it was going to be denied, and start planning to leave. 

It's not right, but I'd rather leave under my own terms than theirs, especially if I had kids. Stephen "PeeWee Himmler" Miller was the architecht of the Family Separation plan in the first term. He loves to inflict cruelty, its his thing. If I had kids, I'd be worried that once in his system, they will find a chance to inflict cruel pain. My friends processes took years with multiple court appearances but they did what they were told and they are still here, but now as citizens.

The website stopped telling me how long it would take about 4 months ago. I want to travel to see my grandmother &amp; I was told I can travel with the receipt that i applied for new one &amp;  my old card. It's about damn time. My sister who was raised in America with all of her three sisters is not allowed to come here and she was raised here from the age of three until age 21. Granted, she lives in a good country, Iceland but the immigration services will not let her come back here because she didn't update her green card in time. All of her family lives here in the usa. No, but based on things online I am expecting the left to get violent over ICE raids. I think we probably are getting closer to the point where there will be violence.  Protesters by and large aren't trying to persuade people or change anyone's minds, they're doing it as an outlet for their frustration and anger.  Eventually after weeks of being told that ICE agents are "gestapo" or "Nazis" and that they're "kidnapping" people, someone's going to act on that belief.

A person is removable if they lack a valid authorization to remain in the United States. There is no "violent crime," requirement before someone can be deported.

I have no idea what an ICE agent might do in that circumstance ("Hi, I crossed the border ten year ago and have since led a blameless life,") but the person making the admission is removeable (assuming no other facts exist, like seeking asylum).

As far as ICE raids: in general, if an area is open to members of the public, it's open to ICE agents.

If someone crossed the border 10 years ago and has no documentation allowing them to enter into or remain in the United States lawfully, that person would be subject to removal.  There is no requirement that the person be guilty anything else.

I heard a Homan interview where he explained that they are focusing on violent criminals and would love to pick them up from the jail/prison since it is easier and safer (for everyone). However since the sanctuary states and cities won't comply, ICE is going into the communities looking for the violent criminals and if they come across any other deportable persons in the process they will deport them as well.
