I think part of the solution to issues like this is to create criminal culpability for baseless charges. We see the legal system used as a cudgel like this quite often. Scaring people with charges you can't secure a conviction with should be a crime itself. Cops operate under the assumption that serious consequences deter bad behavior so I see no reason that kidnapping charges for bad faith arrests wouldn't keep everyone honest.

We can infer that the SPLC is asserting that the attorney was not part of the masked group because they say he was identified as an observer, although it’s a little weird that they didn’t come out and say “our attorney wasn’t part of the coordinated group that allegedly attacked construction equipment and police officers,” or deny that such an attack ever took place. (That might be because their statement makes no mention of the police’s allegation that there was a group throwing rocks, Molotov cocktails, and fireworks at construction equipment and police officers, in spite of the fact that that’s the basis of the arrests they are condemning).

Whether or not the man is guilty of a crime is unrelated to his status as a legal observer. If I show up to a protest as a legal observer, then join a group and throw Molotov cocktails at people and property, being a legal observer has no bearing on my criminal culpability. Likewise, whether or not this arrest is justified depends on whether there is evidence to support the allegation that the lawyer was part of the coordinated group allegedly engaged in criminal activity.

Until more evidence comes out, I think it’s best to withhold judgment.

I’m not sure why being a “legal observer” would provide any protection from being arrested. I don’t know the specifics of that protest, but if Leo gave an order to disperse and the legal observer didn’t, then that would be that. You can beat the wrap (if it was an unlawful order/arrest) but you can’t beat the ride.

Edit: while I enjoy the downvotes, does anyone have a cite to any case that stands for proposition that being a “legal observer” provides any protections not available to an ordinary person?
