In our 76 years, no judge has been impeached. This is not just an impeachment, this could be a showdown between the executive and the judiciary. 

On one side, impeachment of a judge is a very complicated process. On other hand, a successful impeachment will be seen as a bad name on the judiciary. This is going to be an interesting situation. I have a feeling this judge will resign before the impeachment is passed.

The judiciary of the SC is the only body in this country not answerable to anyone. Had the judiciary recommended just a transfer, no one could have done anything.
Even if they have recommended impeachment, it’ll be a monumental task to impeach a HC judge requiring a 2/3 majority. Keep in mind, no HC judge has ever been successfully impeached in India.

Why should they ? The government must come to the court with the request to file an FIR against a current judge. The CJI then has to agree. Obviously you cannot evade the process via a PIL. Which idiot filed it in the courts lol?

Things to remember as you parse through this case and it’s details:

- Judges and their assets are not covered under the RTI Act.

- The judges in India are appointed by a collegium system of their peers, no such parallel exists anywhere else in the world. This practice violates every single maxim of ‘checks and balances’ for a democracy. 

- The SC whilst imposing this Collegium (CJI+4) rule on higher judicial appointments re-litigated the English language itself by interpreting ‘consultation’ (the word actually mentioned in the constitution) as ‘concurrence’. They effectively said that The President can only appoint a judge in the higher judiciary only after the CJI concurs, placing the CJI above the first citizen of the nation. 

- Finally, as the fruit of this hard earned labour over the last 44 years (since the First Judges Case), the judiciary has been able to monopolise the appointment system to such an extent that 41% of all appointments in higher judiciary come from extended legacy judicial families.
