Almost saw the whole debate in the Lok Sabha yesterday and the level of discourse is frankly not very good. Like a lot of opposition MPs were not even talking about the topic at hand but an almost rant like speech on all other things in the country. I mean if the next phase is to get rid of personal laws and bring UCC I'm all for it. And by UCC I'm referring to the one being utilised by governments in the west. If future governments can control religious institutions (them being secular unlike the bjp) something western or communists governments have done, religious tensions can be decreased.

The Waqf Board is a regulatory body for controlling private land donated by Muslims for Muslims as charity. Everyone has the right to do whatever they want with their private property and the Waqf board is a body that is a private landowner just like any other person who owns land in India. It's foolish to oppose something just for the heck of it especially when it'll soon implode in your face. 



This is blatant landgrabbing which is being supported by closeted bigots under the garb of secularism. If you were truly secular, why would you oppose the Waqf board knowing all too well that Muslims have donated huge swathes of land for more than a 100 years now to ensure that the land is used for mosques etc. since the government especially this one is vehemently against anything built by Muslims to practice thier religion?

Any Land can be claimed as Wafq Land , Burden of Proof lies with accused, and special waqf courts where their verdict is final on the matter, cannot be challenged in any other court. This is injustice, even to Muslims whose lands are claimed by Waqf.

This is a very misleading post, the bill makes it fair by providing following amendments are more.

1. Inclusion of Non-Muslim Members: The bill mandates the inclusion of non-Muslim members in both the Central Waqf Council and State Waqf Boards to promote diversity and transparency in the management of Waqf assets.

Take the Times of India for example. In the last five years, they have published dozens of articles on the Waqf issue by Hindutva activists posing as objective information. I discovered this problem when I was searching for information last year. This following article for example has all the falsehoods in one place:

&gt;Section 3 of the Waqf Act, 1995 states that if the Waqf “thinks” that the land belongs to a Muslim, then it is the property of the Waqf. It should be noted here that just “thinking of Waqf” is enough, Waqf Board does not need any proof for this. If Waqf accepts that your property is not yours but Waqf Board’s, then you cannot even go to court. You can approach the Waqf Tribunal Court.

&gt;Section 85 of the Waqf Act states that if you cannot satisfy the Waqf Board Tribunal that it is your own land, then you will be ordered to vacate the land. The decision of the Tribunal will be final. No court, not even the Supreme Court, can change the decision of the Waqf Tribunal.

All of these falsehoods were repeated in Parliament and by ruling party spokesmen.

In reality, there is no Waqf claim, only donations of private property, and as such these require ownership documents. The Waqf board does not travel the country claiming land. Courts routinely overturn Waqf board decisions, e.g. -

Here's another perspective. 

Waqf ammendment is not being brought in because Fanta and Co. are going to appease Mindus. It is not being being brought in to take the rights of Huslims. 

It is brought in to save their own asses. You see, govt (not just today's but previous too) and friends of Fanta and Co. have encroached a lot of Waqf land. And they are now not willing to give it away, so they are ammending the bill. 

But they are painting the picture that Waqf can claim any land, of course, to polarise the issue and bag the sentiment of Mindus. In reality, Waqf can claim only the lands that govt has encroached.

Just waste of money . Waqf amendment bill is right and infact the safest option. On a longer run I am just satisfied BJP didn't eliminate/dismantle waqf like it's extremist  cadres demand . The amends doesn't really seem to affect much of its function. 


In my opinion, I don't think there anything that's challengeable  maybe except allowing other religion people. Which ofc should not be the case but I heard technically it's a charitable trusts so legally nothing can be done.

In the worst-case scenario it can declare the amendment as unconstitutional.

Then, Modi can simply invoke Article 368 or the 9th Amendment to overturn the court's judgement.

Or he can bring an ordinance to overturn the judgement. 

The only thing the supreme court can do is strike down the amendment on the basis of the claim that it violates the BASIC STRUCTURE OF THE CONSTITUTION.

However, this amendment doesn't violate the basic structure of the Indian constitution at all. 

So in short, it is all up to Modi. 

What Modi wants to do? Does he want to overturn the court's judgement by bringing an ordinance, invoking Article 368, or using the 9th amendment.
