An American is ready to work around 55$/hr - still failed in interview, where as it is impossible to find H1B candidates below 65$/hr (excluding employer cut).

The $100K is a start, but it is not good enough.

Really, all you need is to set a lower limit for the salary of any H1B. Depending on the industry.

Set it to $200K for IT people. Set it to $300K for doctors. Set it to $150K for nurses (most nurses do not come to the US on H1B visas anyway). If you want to import plumbers, set it to $120K for them. etc.

Would eliminate most of the Indian slave mills like Tata, InfoSys, WiPro etc. almost overnight.

Revise the lower salary limits yearly.

H1B abuse is so rampant that that 60-70% of H1B applicants are from India and there's a structured pipeline for Indians to get a US masters degree in business or tech, then get an H1B, get paid a US salary, send remittance back home.

Trump already caved on this issue. It’s not 100k per year it’s only a one time payment on the visa request. The vast majority of people are immune to the change and they didn’t restrict families coming over after the visa holders.

Im sorry, are you asking if it’s fair that anyone who wants to *apply* for a non-permanent visa needs to pay $100k to do so? Considering 99% of US citizens will never have a lump sum of $100k disposable income so no I don’t think it’s fair. 

It will continue what is already happening, a massive decline in interest in coming to the US for any reason, let alone to work. Why would anyone want to come here when there are massive grabs on anyone even suspected of being here illegally and the administration has vocalized loudly that they will revoke visas for any reason they see fit?

I know several tech people who are struggling to find work right now. It doesn't make sense to give all those jobs to foreign nationals when our own people are hurting. When we have more jobs than people, we can open the books to foreigners again. Nothing against them.

I think it is fair because it gives foreign companies a better advantage competing with the Americans. Thank you Trump!

Of course this “reform” is flawed. The H1B visa isn’t easy to get. I would know as I had one to get into the US. It took months because you had to prove - or rather those hiring you - had to prove that you had a unique set of skills not available in the US. It is only valid for a limited time and can only be renewed for a limited time. The reason why it exists is because the US ranks 31st in education and has a shortage of highly skilled workers in very specific roles - especially in healthcare, tech &amp; engineering, and even finance and certain skills trades and manufacturing. Healthcare will suffer because nurses are already underpaid and won’t pay $100k to bring someone in. Tech jobs will simply be remote so money leaving the US instead of staying in the US. But then, this administration has not been good for the economy - housing market is contracting, inflation is way up etc.

If you buy the logic that this is meant to protect American jobs (which I don’t, more on that in a moment), the flaw is that you can only hire Americans to do these jobs if you have Americans qualified to do them, which we don’t. Our workforce is, frankly, stupid. You have a mass of relatively low-skill, undereducated people who have little interest in learning anything at all. And on top of that, the education system is being gutted to the point that we couldn’t produce educated workers en masse even if we wanted to.

My conspiracy theory is that this is being pushed by AI CEO’s to make it harder for American companies to hire qualified humans and force them to increase their reliance on emerging AI technologies.

I think it shows we need reform in regards to our work visas. we need to shift workers from tech and into other industries that require high skilled workers like nursing. we have too many tech workers out of work and skilled kids unemployed coming out of college with tech degrees. this should reduce the tech visas and open up other areas that have need for them. we need the ability to shift as demand is required and not bend the knee to lobbyists of tech industrie. I think the fee is excessive but not in regards to over saturated areas like tech.

The reform is chaotic and will have overall negative consequences in the longterm (even if it is found illegal). It will hurt smaller startups and universities. Without having the upfront capital, American research hegemony and job creation in tech sector will suffer. As for prioritizing higher salaries, this could backfire on the adminstration. There will be loopholes found by these WITCH companies that allow them to garner a greater share of the talent pool than before.

A few thoughts.
1. It would be better to raise the minimum wage for H1B by industry.
2. Current 100k fee is basically a tax that creates big govt spending and doesn't benefit either the employer or the employee.
3. Since this is a flat fee not categorized by industry, it is biased for big tech who can still afford to pay but will disadvantage smaller startups, academia and non-tech industry.
4. Such a prohibitive fee on new work visas essentially spells the end of legal immigration. This exposes the old tired defense from republicans that they are only against illegal immigration. Truth is that it was always about race and culture. There will be many excuses, but the hidden goal is clear.

Idk when the switch happened in my brain, but knowing there are people, children in the US still starving. People in the US struggling to find work, struggling to pay for their education or support their families. I have a hard time caring about the immigrants coming into the US.

When we start taking care of Americans here then we can start taking care of immigrants too.

The medical establishment is going to be reeling, doctors are already in short supply, H1B visas help shore up that shortfall. The result is either medical costs getting even more out of control to cover what may be millions of dollars in fees or medical systems shrinking with their skilled workforce.   
  
This likely means already underserved areas are going to be unserved in the future, which isn't great considering those same medical systems just took a major blow from cuts in the spending bill and were already headed that way.

Companies don’t pay a premium to have office workers. They use RTO to get people to quit, so they can cut head count without having to call it layoffs and paying severance.

H1Bs are just the new way of outsourcing. There’s no reason why American companies can’t hire Americans.

I think the reform makes a lot of sense. I generally lean on the Dems/Leftists' side, but they have some insane takes. Before the order, H1B visas were weighted the same regardless of pay. So they were hiring fresh grads. Why couldn't the many American CS majors be trained to do that work? Oh wait, because you couldn't fire them.

The reforms should make it so that the visas only go to truly experienced workers

However, I'm not sure if the talk about them just expanding overseas hiring is true. If they needed to save money overseas, then why aren't those people already hired there? Is there no value in them working in person in the US?

Though I'm not sure how this will affect academia or rural america.

As someone working in a tech company, since this changes we were informated new hires now are working a year on Dublin, London or Vancouver so they can get L1 visa. We also had a meeting saying we will have more peers overseas due to their global expansion (yeah sure) and we need to get better to work in group with people on different sites

Any and all forms of immigration/visas/green cards/etc should be free and near instant, with zero friction. Just like back with Ellis Island where all you needed was to show up to be accepted in.

The US is a nation made by immigrants. You cannot be mad about immigration, because you are a descendant of immigrants (unless you are 100% pure native american).

It may affect only new visas, but it is certainly a strong signal to Indians that they are no longer welcome in USA. Next they can start creating issues about spouse visas or spouse working visas so they can't have children which claim birthright citizenship and similar other barriers to entry.

So all in all it is a strong signal to Indians living in USA.

Its effects:

We will have 40K more Indians staying behind for jobs. So extra competition in job market.  
More companies will come to India to setup office if they still find Indian outsourcing profitable. However, trump will again do something to stop it.

NRIs with cash will buy atleast 1 property in India.  
Existing software employees can delay property buying decision till there is more clarity about their future prospects.

From start it was clear that 100000 dollar per year for new applicant would be applicable. Now that that has been revised to 100000 dollar one time. 

But it's amount is large enough to discourge fresher to be hired on h1b by employer. Anyways job market for h1b was bad last too for mba graduating from top colleges on students visa.
