While I would not wish this even on my enemy, I feel the government fears that a trial will make a hero out of him and every such sleeper cell separatist will have a precedent to add fuel to a fire.
We already have enough of separatist movements going across northeast and Kashmiri subreddit is notorious for supporting terrorist which essentially are separatists.
It is sad that the government decided to make an example of a young boy who likely made a mistake of his life.

Laws like UAPA and PMLA are designed to keep "undesirables" in jail permanently, without trial or bail. Only illiterate people think that whoever is arrested are bad guys. In reality, the police is corrupt, and the government is draconian. The prosecutor (like Tushar Mehta here) is always someone who takes orders from the government and enjoys prosecuting the powerless.

It was definitely caused by their lawyers to a certain extent. The lawyers had been forum shopping and jumping queues, like going straight to the higher courts directly instead of the lower courts, seeking an excessive number of adjournements, withdrawing applications and filing afresh multiple times, etc. All of this is on record. All of this costs time and the courts move at their own pace anyway.

At the same time, the police and the courts should have proceeded with the case. The severity of the charges is the major thing preventing them from getting bail right now, but the issue of bail is only anciliary as far as the trial itself is concerned.

That being said, I hope these terrorist PoSs rot in jail. Or receive the capital punishment (some charges therein carry this). Enough of their seditious bullshit.

NAL but beware of propaganda around the case. I don't believe Umar has incited the riots, I believe the trial is being stalled to keep them in jail for as long as possible because if a trial were to happen and they were found not guilty, it would reflect very badly on the government.

- Proceedings are naturally slow under UAPA (Unlawful Activities Prevention Act), because:

- Huge charge sheet (3,000+ pages, 23,000+ pages of annexures).

- Multiple accused persons.

- Electronic evidence and technical witnesses.

That means even without adjournment requests, cases like this move slowly.


#Supreme Court Bail Plea (Apr 2023 - Feb 2024)#

~11 to 12 adjournments total (depending on source).

Out of these:

- 2 to 4 adjournments were at the request of Umar Khalid’s own lawyers (because of scheduling conflicts or requesting more time).

- Several adjournments (5–7) happened because the bench itself deferred (change of roster, judges unavailable, or court deciding to hear later).

- 1-2 adjournments were due to Delhi Police/prosecution.

- Some adjournments were joint (both sides agreed).
